Movement + Stillness & YogE LLC Retreat Waiver and Release PARTICIPATION & RISK: I have chosen to participate in the Costa Rica Soul retreat and recognize that all activities are voluntary. I acknowledge that I understand the nature of the activities I will be participating in and the possibility that despite precautions, accidents and/or physical injury may occur. I understand that not all exercise programs are appropriate for all people and that in not forcing, straining, or overexerting myself while exercising, the risk of injury may be reduced. I acknowledge that activities like yoga and dance carry inherent risks of injury that can't be completely eradicated. If I experience any pain or discomfort, I agree that I will discontinue the activity, and ask for support from the instructors. By signing, I affirm that the status of my health and physical condition is sufficient to allow me to participate in the physical activity that I am partaking in on the wellness retreat. I agree that I will make the instructor aware of any medical conditions or physical limitations before class. If I am pregnant, become pregnant or I am post-natal or post-surgical, my signature verifies that I have my physician's approval to participate. I also affirm that I alone am responsible to decide whether to practice yoga/dance and my participation is at my own risk. I agree to irrevocably release and waive any claims that I have now or may have hereafter against Movement + Stillness, Shara Kees, YogE LLC, and Erica Gerard and any additional instructors. In case of an emergency and in the event that my emergency contact cannot be reached, I authorize the staff at Danyasa Eco Retreat with Movement + Stillness, Shara Kees, YogE LLC, and Erica Gerard to obtain whatever medical treatment is deemed necessary for my welfare. I further understand and agree that I will be financially responsible for all charges and fees incurred in the rendering of said emergency treatment regardless of whether or not my insurance would cover such charges and fees. In signing below, I agree by engaging in the retreat activities, including travel, excursions, classes, and workshops with Movement + Stillness, Shara Kees, YogE LLC, and Erica Gerard, I do so at my own risk. This includes, without limitation, my use of any public or private outdoor and indoor spaces or buildings, any apparatus in the practice area, and my participation in any activity, class program or instruction associated with Movement + Stillness, Shara Kees, YogE LLC, and Erica Gerard. I agree that I am voluntarily participating in these activities and using these props and premises, and assume all risk of injury, illness, damage or loss to me or my property that might result, including, without limitation, any loss or theft of any personal property. I assume full responsibility for any and all damages that I may incur a result of my participation in the retreat activities. I agree on behalf of myself (and my personal representatives, heirs, administrators, executors, agents, and assigns) to release and discharge Movement + Stillness, Shara Kees, YogE LLC, and Erica Gerard and his/her instructors (and affiliates, employees, agents, representatives and assigns) from any and all claims or causes of action (known and unknown) arising out of their negligence. I agree to release and hold harmless Movement + Stillness, Shara Kees, YogE LLC, and Erica Gerard from any cause of action, claims, or demands now and in the future. I will not hold liable Movement + Stillness, Shara Kees, YogE LLC, Erica Gerard or Danyasa Eco Retreat for any personal injury or any personal property damage or loss, which may occur on the premises before, during or after the retreat or at any sponsored event outside the retreat. Furthermore, I agree to take full responsibility for my/our behavior that result in any damage I/we may cause to the retreat center or hotel accommodations, to include but not limited to cost for reparations. This waiver and release of liability includes, without limitation, injuries which may occur as a result of a) my use of any equipment or facilities which may malfunction or break, b) improper maintenance of any equipment, c) negligent instruction or supervision and d) slipping and falling while in the practice area and surrounding property. I acknowledge that I have carefully read this waiver and release and fully understand that it is a release of liability. I understand that I am waiving any right that to bring a legal action to assert a claim against us, Movement + Stillness, Shara Kees, YogE LLC, and Erica Gerard, Danyasa Eco Retreat Center, the property owners, the community of Dominical Costa Rica for our negligence. TRAVEL INSURANCE WAIVER: I acknowledge that it has been recommended to me to invest in travel insurance on my own, and that I am willing to assume risk by opting out of this insurance should I need to cancel or remove myself from participation due to illness. I understand that no refunds will be provided and any additional expenses related to travel or accommodation changes will be at my own expense. MEDIA WAIVER: I hereby grant to Movement + Stillness, Shara Kees, YogE LLC, Erica Gerard and Danyasa Eco Retreat and any licensees, agents, and assignees thereof (collectively, “Photographer”) the perpetual, irrevocable, global and unrestricted right to use, reproduce, publish and copyright (collectively, "Use") my picture, likeness, and voice (collectively, "Image") in any media for publicity, art, advertising, trade, or for any other lawful purpose. I understand that my Image may be substantially edited, altered, or modified. I hereby waive any right to inspect or approve Photographer's Use of my Image in any media. I grant Photographer the right to market and sell copies of my Image. I also waive any right to royalties or other compensation related to Photographer's Use of my Image. I release Photographer and any legal representatives and assignees thereof from any claims in connection with the Use of my Image. I intend for this agreement to bind all of my heirs, assignees, personal representatives, and members of my family. EXECUTION OF WAIVER: By selecting I agree below this is proof of my intention to execute a complete and unconditional waiver and release of all liability pursuant to the terms herein, and agreement as to all terms and conditions contained above. I am at least 18 years old, have read and understand this agreement, and am competent to execute it. Agreeing to participate in the Costa Rica Soul Retreat, is an agreement to this waiver. I HAVE FULLY INFORMED MYSELF AS TO THE CONTENTS OF THIS RELEASE AND HAVE READ THE SAME PRIOR TO MAKING MY SELECTION BELOW.
